LH Performance & Recovery provides treatment to clients aged 18 and over only. Under-18s are not accepted.
Who is responsible for your information
Lewis Hanson, trading as LH Performance & Recovery, is responsible for client personal information. Contact Lewis at Zion Muay Thai, 1A Kenworthy Road, Stafford, ST16 3DY, or on 07376 332906, for privacy questions or requests.
What information is collected
Appointment and enquiry information may include your name, contact details, appointment information and payment records. Consultation and pre-treatment screening may include relevant medical history, current or previous injuries, medication relevant to treatment, training and activity, treatment goals, precautions, consent, previous treatment, treatment notes and follow-up information.
Only health information relevant to treatment suitability and providing a safe service is requested. Please provide accurate information and tell Lewis about relevant changes before treatment.
How information is used
- Managing appointments and communicating about bookings or treatment.
- Screening, assessment, treatment planning and providing sports massage and recovery treatments.
- Maintaining appropriate treatment and consent records.
- Meeting applicable professional, insurance, legal and accounting requirements.
Information necessary to arrange and provide your agreed service is used on the basis of contract under Article 6(1)(b) UK GDPR. Accounting and other required records are processed where a legal obligation applies. Information is not sold or shared with unrelated third parties for marketing.
Health information and explicit consent
Health information is special-category personal data under UK GDPR and receives additional protection. For health information used for screening, assessment, treatment planning and treatment delivery, our basis is Article 6(1)(b) (contract), together with Article 9(2)(a) (explicit consent).
Before your health information is collected and used, you will be asked to give explicit consent in a separate section of the consultation form. This is distinct from consent to receive treatment, and the consent choice will not be pre-ticked.
You can withdraw your health-data consent by contacting Lewis. This does not affect processing already carried out lawfully. If necessary health information cannot be used to check treatment suitability, treatment may need to be deferred.
Complaints and legal claims
Where retaining relevant records is necessary for establishing, exercising or defending legal claims, including a complaint involving a potential legal claim, a separate lawful basis may apply: Article 6(1)(f) (legitimate interests) together with Article 9(2)(f) (establishment, exercise or defence of legal claims). This is assessed according to the circumstances, necessity and your rights. Withdrawal of consent does not automatically require deletion of records that can lawfully be retained on this separate basis.
Storage and access
Client consultation forms and treatment notes are currently kept as paper records. They are stored in a locked drawer inside the treatment room, and the treatment room is locked outside treatment hours.
Access to client records is restricted to authorised persons who need access for a legitimate purpose relating to your service or applicable professional, legal or insurance requirements.
How long records are kept
Client records are retained only for as long as necessary for the purposes for which they were collected and in accordance with applicable legal, insurance and professional requirements. Our retention periods are kept under review.
Our insurer is Markel. Relevant requirements under the applicable policy are considered when reviewing retention arrangements. Once the applicable retention period expires and there is no justified reason for further retention, paper records will be securely destroyed.
Bookings, enquiries and other providers
Square handles online bookings and payment processing. The website enquiry composer creates a WhatsApp message in your browser; it does not submit or store your entries on this website. If you send the message in WhatsApp, Lewis receives the information you choose to provide. Please keep medical details for the consultation and screening process.
Square and WhatsApp process information under their applicable terms and privacy policies. Instagram and Google Maps are also external services. Please review their privacy information when using them; their processing may involve locations outside the UK.
Information will not normally be shared with another healthcare professional without your knowledge or appropriate consent, unless there is another lawful reason for disclosure. Relevant information may be disclosed where required by law or lawfully necessary for an insurance matter.
Website cookies
This website does not set analytics or advertising cookies. Its hosting service may process basic technical request information to deliver and secure the website. External booking, messaging, mapping and social services may use cookies under their own policies.
Your data-protection rights
Depending on the circumstances and lawful basis, you may have rights to access your information, correct inaccuracies, request erasure or restriction, object to processing, and receive or transfer certain information. Where processing relies on consent, you can withdraw that consent; this does not affect processing already carried out lawfully.
Some information may need to be retained to meet legal obligations or for legal claims. Requests are considered under the applicable data-protection rules.
